Judge issues injunction against Uber: Drivers are employees
Judge Ethan Schulman of the Superior Court of the State of California, San Francisco, ordered Uber to reclassify its drivers as employees on August 10, 2020, and to provide their drivers with the same protections and benefits as their other employees, in compliance with AB5, and as passed into law on September 4, 2019.
The order entitles Uber drivers to workers comp, unemployment, paid sick and family leave, and health insurance, among other employee benefits. "To state the obvious, drivers are central, not tangential, to Uber and Lyft's entire ride-hailing business," Judge Schulman wrote. The case was filed by the Attorney General of California and joined by the City Attorneys for Los Angeles, San Diego, and San Francisco.
